Returns and complaints

  1. Complaints

  1. The Seller's obligation is to deliver to the Buyer Goods free from defects. The Seller is liable to the Consumer for the lack of conformity of the Goods with the concluded Agreement.

  2. The Seller is liable to the Consumer if the Goods sold have a physical or legal defect.

  3. Before accepting the shipment with the purchased Goods, the Customer should check whether the shipment has not been damaged during transport. In the event of damage, the Buyer is entitled to refuse to accept the shipment and then contact the Seller to determine the further course of action.

  4. In the event of non-conformity of the Goods with the Agreement, the Consumer should immediately inform the Seller of this fact, at the same time specifying his claim related to the identified defect or submitting a declaration of appropriate content.

  5. Complaints may be submitted electronically to the following e-mail address: sprzedaz@aidc.com.pl or in writing to the Seller's correspondence address - Wilków Polski 28, 05-155 Leoncin. The Buyer may use the complaint form available in these Regulations as an attachment.

  6. In the event of delivery of a damaged Product or a manufacturing defect, the Buyer should deliver the Goods at his own expense to the Seller together with proof of purchase in order to process the complaint.

  7. The Seller will consider the complaint and inform the Buyer about the resolution of the matter electronically immediately, but no later than within 14 business days of notification.

  8. The Seller does not accept any returns sent cash on delivery.

  9. When submitting a complaint, the Customer should include the following information:

    1. e-mail address used when placing the order;

    2. date and order number;

    3. justification of the complaint with a clear indication of what the complaint concerns (in particular the type and date of occurrence of the defect);

    4. a request for a method of bringing the Goods into compliance with the Agreement or a declaration of a price reduction or withdrawal from the Agreement and the contact details of the person submitting the complaint.

  1. In the event of receiving an incomplete complaint, the Seller will request the Buyer to complete it under penalty of the complaint being left without consideration.

  2. Any complaints may be submitted by the Client via e-mail to the following e-mail address: sprzedaz@aidc.com.pl

  3. If the complaint is accepted, i.e. if it is found that the Product has a physical or legal defect, the Seller, in accordance with the applicable provisions of the Civil Code regarding warranty and taking into account the Consumer's requests, will replace the defective Product with a defect-free one (if possible) or remove the defects.

  4. In the event that the Consumer submits a declaration of a price reduction, the Seller shall return the Goods to the Consumer and refund part of the Price. The part of the Goods Price subject to refund is determined in such proportion to the price of the Goods resulting from the Agreement, in which the value of the Goods with a defect remains to the value of the Goods without a defect.

  5. In the event of withdrawal from the Sales Agreement by the Consumer, the Seller will refund the price of the Goods.

  6. If the replacement of the Goods or the removal of the defect of the Goods is impossible or would require excessive costs, the Seller may refuse to satisfy the Consumer's request. In such a case, the Seller will refund the price of the Goods.

  7. The Store does not conduct exchanges . Therefore, to exchange the Goods, you must return them and place a new order in the Store.

  8. Products must not show any signs of use and must be returned in their original packaging together with the return form and proof of purchase.

  9. The Buyer will be informed about the method of handling the complaint within 14 days from the date of filing the complaint. In the event that the Customer requests the exchange of the Goods for a defect-free one, removal of the defect or a reduction in price, the Seller's failure to respond to the request within the above period will mean that the request is considered justified.

  10. None of the provisions of the Regulations limit the Customer in exercising his rights under the warranty referred to in the provisions of the Civil Code.

  11. In matters not regulated above in the case of a Consumer, the provisions of the Civil Code shall apply.

  12. In the case of outlet products, before concluding the Agreement, the Seller clearly informs the Customer that the subject of the sale is outlet Goods. The Customer should therefore be aware that in such a situation they will receive a product that is sold at a lower price, but contains a defect described in the Product card. If the Customer decides to purchase Goods marked as outlet products, the Seller may assume that the Customer accepts the purchase of a defective product. In accordance with art. 557 of the Civil Code, the Seller is released from liability under warranty if the Customer knew about the defect at the time of concluding the Agreement. Therefore, in the case of outlet products, the Customer is not entitled to rights related to warranty (e.g. in the form of the right to exchange the product for a full-value product free from defects).

  13. The above provisions also apply to Entrepreneurs with consumer rights.

  1. Withdrawal from the contract by the Consumer or the Entrepreneur with consumer rights

  1. Only the Consumer or the Entrepreneur with consumer rights, who has concluded a Distance Agreement with the Seller, has the right to withdraw from the Agreement without giving a reason within 14 days without giving any reason. The deadline for withdrawal from the agreement expires after 14 days from the day on which the Consumer or the Entrepreneur with consumer rights came into possession of the item or on which a third party other than the carrier and indicated by the Consumer or the Entrepreneur with consumer rights came into possession of the item.

  2. In order to meet the deadline for withdrawal from the Agreement, it is sufficient for the Consumer or the Entrepreneur with consumer rights to send the Seller information concerning the exercise of the right of withdrawal from the Agreement to which the Consumer or the Entrepreneur with consumer rights is entitled before the deadline for withdrawal from the Agreement expires.

  3. In order to withdraw from the Agreement, the Consumer or Entrepreneur with consumer rights must inform the Seller of their decision to withdraw from the Agreement by means of an unequivocal statement, e.g. in the form of a letter sent by e-mail to the e-mail address: sprzedaz@aidc.com.pl or by traditional mail to the correspondence address of the Seller – Wilków Polski 28, 05-155 Leoncin. In order to meet the deadline for withdrawal from the agreement, it is sufficient to send information regarding the exercise of the right of the Consumer or Entrepreneur with consumer rights to withdraw from the agreement before the expiry of the deadline for withdrawal from the agreement.

  4. A consumer or an entrepreneur with consumer rights may use the model withdrawal form.

  5. The Consumer or Entrepreneur with consumer rights should attach proof of purchase of the Goods to the declaration referred to above, or otherwise document their purchase.

  6. In the event of withdrawal from the contract, the Consumer or Entrepreneur with consumer rights is obliged to return the Goods subject to return in an unchanged state, unless the change was necessary within the limits of ordinary management. The Consumer or Entrepreneur with consumer rights is obliged to return the Goods to the Seller no later than 14 days from the date on which he withdrew from the Contract. To meet the deadline, it is sufficient to return the Goods before it expires.

  7. The Consumer or Entrepreneur with consumer rights bears the direct costs of returning the Products.

  8. The Seller does not accept any returns sent cash on delivery .

  9. In the event of withdrawal from the Agreement, the Seller shall return to the Consumer or Entrepreneur with consumer rights all payments received from the Consumer or Entrepreneur with consumer rights (including the cheapest cost of delivering the Goods available in the Store - if this cost was covered by the Consumer or Entrepreneur with consumer rights) no later than within 14 days from the day on which the Seller was informed about the exercise of the right to withdraw from the Agreement.

  10. The refund will be made using the same payment methods that were used by the Consumer or Entrepreneur with consumer rights when placing the order, unless the Consumer or Entrepreneur with consumer rights has expressly agreed to a refund in a different form. In each case, the Consumer or Entrepreneur with consumer rights will not incur any fees in connection with the form of payment refund.

  11. The Seller may withhold the refund of payments received from the Consumer or Entrepreneur with consumer rights until the Goods are received back or until the Consumer or Entrepreneur with consumer rights provides proof of sending them back, depending on which event occurs first.

  12. The Consumer or the Entrepreneur with consumer rights is liable for the reduction in the value of the Goods resulting from the use of the Goods in a way that goes beyond what is necessary to establish the nature, characteristics and functioning of the product.

  13. The right to withdraw from a contract concluded at a distance does not apply to the Consumer or the Entrepreneur with consumer rights in the following cases:

    1. in which the price or remuneration depends on fluctuations in the financial market over which the Seller has no control and which may occur before the deadline for withdrawal from the contract expires;

    2. where the subject of the provision is a non-prefabricated item, manufactured according to the consumer’s specifications or intended to meet his individual needs;

    3. where the subject of the service is an item delivered in a sealed package which cannot be returned after opening the package due to health protection or hygiene reasons,

    4. if the packaging has been opened after delivery;

    5. where the subject of the performance are things that after delivery, due to their nature, are inseparably connected with other things.

  14. In the case of a Customer who is not a Consumer or an Entrepreneur with consumer rights, the provisions of the Civil Code apply.
